Thank you for the clarification. I agree totally the extra two seats installed in the 4 place BH5 would create problems during a ramp check while operating under Sport Pilot privileges. A Type Certificated aircraft more than 4 seats identified on the TSDS as such cannot be operated under Sport Pilot privileges even with two seats removed.....the reason for me asking the BH brain trust.

And that the Bearhawk 5 was registered as a 4 place, and the operating limitations say 4 place, and the POH says 4 place, and the DAR only sees 4 places and no potential to sneak in a couple of jump seats. And once a 4 place, always a 4 place.
There's a strong reason that FAA limited Sport Pilot to 4 place aircraft (with only 2 occupied). They intentional didn't want the 6 place aircraft sneaking under the Sport Pilot privileges.John Hansen
